Yes — but only under very specific conditions.

⚖️ NJ Courts Use the Carfagno Test — 11 Factors Judges Consider:
-
Whether the victim consents to vacate the order
-
Whether the victim fears the defendant
-
Current relationship between the parties
-
Any FRO violations since entry
-
Criminal history since the FRO
-
Evidence of drug or alcohol abuse
-
Other violent conduct since the FRO
-
Remorse or rehabilitation efforts
-
Age and health of both parties

💬 FAQs
Q: Can the other party drop the order?
🟢 Yes — the plaintiff can ask to vacate the FRO, but a judge must approve it on the record in court. It is not automatic.
Q: Will the plaintiff be notified if I file to vacate?
🟢 Yes. They will be notified and have the right to appear and object. Their input matters, but the judge decides.
Q: Do I need an attorney?
🟢 Yes. These motions are complex and high-stakes. You’ll need written certifications, evidence, and proper legal representation in Family Court.
